1. Acceptance of Terms

By accessing this website or placing an order with Pop & Bloom Seattle, LLC (“we,” “us,” “our”), you agree to be bound by these Terms of Service (“Terms”) and any policies referenced herein.

If you do not agree to these Terms, please do not use this website or place an order.

2. Eligibility

By using this website or placing an order, you represent that you are at least 18 years of age or have the consent of a parent or legal guardian.

3. Products & Custom Orders

All products offered by Pop & Bloom Seattle are custom-made and handcrafted. Customers select a specific bouquet or design as displayed on our website. Customers do not select individual balloon colors unless explicitly stated. Each arrangement is created to closely match the selected design; however, exact replication is not guaranteed. Due to the handmade nature of our products and variations in lighting, balloon materials, and production batches, minor differences in color tone, finish, size, or arrangement are normal and expected. Product images are representative and provided for inspiration only.

4. Orders, Pricing & Payment

All prices are listed in U.S. dollars and are subject to change without notice. Payment in full is required at checkout before an order is processed. We reserve the right to refuse or cancel any order due to pricing errors, availability limitations, or suspected fraudulent activity. Applicable taxes and delivery fees are calculated at checkout.

5. Delivery Policy

Pop & Bloom Seattle offers delivery only. We do not offer in-person pickup.

Delivery Area

We currently offer local delivery within the greater Seattle area. Delivery availability is subject to distance, scheduling capacity, and order date.

Delivery Timing

Delivery times are estimated delivery windows, not guaranteed arrival times. Delays may occur due to traffic conditions, weather, building access restrictions, or recipient availability. The customer is responsible for providing accurate delivery information and ensuring recipient availability. Additional fees may apply for failed or delayed deliveries caused by incorrect information or lack of access.

6. Cancellations, Returns & Refunds

Because our products are custom-made and time-sensitive:

All sales are final
Cancellations are permitted within 24 hours of placing an order
No cancellations are accepted after this period

Damages & Issues

If an order arrives damaged or incorrect due to our error, the customer must notify us within 2 hours of delivery, accompanied by clear photographic evidence.

Approved claims may be resolved with a replacement or partial refund at our discretion. We do not offer refunds for subjective dissatisfaction, environmental damage, or issues arising after delivery.

7. Product Care & Responsibility

Balloon lifespan varies based on environmental conditions, including temperature, sunlight exposure, humidity, handling, and surrounding surfaces. Once an order has been delivered, Pop & Bloom Seattle is not responsible for popping, deflation, fading, or damage caused by environmental factors or handling.

8. Website Use & User Content

We may allow customers to submit reviews, comments, or photographs (“User Content”).

By submitting User Content, you grant Pop & Bloom Seattle a non-exclusive, royalty-free license to display such content for business and marketing purposes.

We reserve the right to moderate, edit, or remove User Content that is inaccurate, misleading, abusive, inappropriate, or not reflective of the actual product or experience.

9. Intellectual Property

All website content, including images, designs, text, logos, product names, and branding, is the exclusive property of Pop & Bloom Seattle, LLC and may not be copied, reproduced, or used without prior written consent.

10. Disclaimer of Warranties

All products and services are provided “as is” and “as available.” We make no guarantees regarding longevity, performance, or suitability beyond delivery.

11. Limitation of Liability

To the fullest extent permitted by law: In no event shall our liability exceed the total amount paid for the applicable order, to the fullest extent permitted by law. We are not liable for indirect, incidental, consequential, or emotional damages, including but not limited to event costs, lost opportunities, or third-party expenses.

12. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including weather conditions, traffic incidents, natural disasters, power outages, governmental actions, or other unforeseen circumstances.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Washington.

Any disputes arising from these Terms or the use of this website shall be resolved exclusively in the state or federal courts located in Washington State.

14. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
